1. Organiser & Eligibility

1.1 The One Thing I Can Do To Protect The Earth” Facebook Contest (“the Contest”) is open to all Malaysians, permanent residents of Malaysia with a valid Residence Pass aged 18 and above as at the date of participating (“the Participant or Participants”).

1.2 The representatives, employees, servants and/or agents of advertising and/or promotion service providers of the organiser (including its affiliates and/or related companies), and their immediate family members (children, parents, siblings, including spouse) shall not be eligible to participate in the Contest.                                                                                                         

2. Contest Period

2.1 The Contest will commence from 28 March 2025 at 12.00am to 30 April 2025 at 11.59 pm (GMT+8) (“Contest Period”).

2.2 The organiser may at its sole and absolute discretion vary, change or extend the Contest Period at any time without prior notice. Unless otherwise varied to the contrary by the organiser, all participation in the Contest shall be governed by the Terms and Conditions set out herein which shall remain in full force and effect at all times. Entries received outside the Contest Period shall automatically be disqualified.

3. How to Participate

3.1 Steps:

a. take an original photograph showing one meaningful action you are taking to protect the Earth.

b. post the photograph on Facebook with a caption explaining the environmental action you took to protect the Earth (maximum 100 words).

c. the post shall include one of the official Contest hashtags of the individual mall:

d. ensure your post/account is set to public during the Contest Period.

3.2  The photos taken by the Participant shall adhere with the following:

a. Photos must be original works taken by the Participant and have not been published/exhibited elsewhere.

b. Photos must clearly depict an environmental action or initiative to protect the environment.

c. Photos should be in digital format (both colour and monochrome photos).

d. Photos must be in its original state and cannot be altered in anyway including but not limited to removing, adding, reverting or distorting subjects within the frame except for slight adjustment on brightness, contrast or color.

e. Photos must not be edited or manipulated which would be misrepresented for any action shown.

f. Photos must not infringe any trademarks, copyright, patent or any other intellectual property rights of any third party.

g. Photos must not subject to any claim, opposition, assertion of infringement of any trademarks, copyright, patent or any other intellectual property rights by any third party.

h. Photos shall not show or represent any specific brands, companies or organization.

i. The content of the photos shall not be inappropriate, offensive, discriminatory (religion, race, descent or place of birth) or vulgar.

4. Prizes

4.1 Winners for the Prizes in the Contest will be judged based on the following criteria:

a. Visual Impact (25%) – Composition, lighting, and overall aesthetic quality

b. Creativity & Originality (25%) – Unique perspective or approach to environmental action

c. Communication effectiveness (50%) – convey the environmental message clearly in an engaging way

4.2 The organizer shall select the best photo to be determine as the winner of the Contest. The organizer and its panel of judges reserve their absolute right to assess and determine each and every submission during the selection process.

4.3 Selected winner(s) of the Prizes in the Contest will be contacted based on the contact information provided in Facebook via Facebook Messenger. In the event the organiser is unable to contact the selected winner(s) after three (3) attempts, the organiser reserves the right to forfeit eligibility of the shortlisted winners(s) and select the next eligible Participant as the shortlisted winner and the non-contactable shortlisted winner(s) shall have no claim whatsoever against the organiser on the cancellation and the forfeiture.

4.4 All Prizes are given are non-exchangeable, non-transferable or non-redeemable for cash, credit, other items or voucher, in part of in full. The organiser makes no warranties or representations whatsoever with respect to the Prizes and shall not be responsible nor liable for any problems and/or damage there to or arising there from.

4.5 Each Participant may submit as many entries as he/she wishes but each Participant (if shortlisted as winner) is entitled to only in the Contest during the Contest Period.

4.6 The values of the prize(s) are accurate at the time of the publication of these Terms and Conditions. The organiser reserves the right at its absolute discretion to substitute any of the prizes with alternative prizes of similar value, at any time without prior notice.

4.7 All entries must be received by the organiser latest by 30 April 2025, 11:59pm. Any entries received after the stipulated time will be rejected and deemed invalid.

4.8 The Participant is responsible for any and all taxes payable as a result of a prize being awarded or received (if applicable).

4.9 In the event that the Participant chooses not to accept or collect the Prize, fails to show up during the agreed time of Prize collection or fails to collect the Prize by the stipulated timeline, the Prize shall be forfeited and the Prize will be dealt at the absolute discretion of the organiser and/or the organiser reserve its right to select the next eligible Participant as the winner.

4.10 All Prizes are accepted entirely at the risk of the Participant and are awarded by the organiser without any warranty of any kind express or implied. The Participant shall execute a deed of release and indemnity in a form prescribed by the organiser, if so required, in order to receive the Prize.

4.11 The Participant and winner shall assume full liability and responsibility for any liability, unexpected event, injury, damage, claim or accident (including death) caused by their participation in this Contest and/or redemption and/or use of the prizes and agree to release the organiser and its agencies from any claim whatsoever for any injury, accident, loss of life nor loss of economy and others.

4.12 To the fullest extent permitted by law, in no event the organiser or any of its officer, employee, representative and / or agent (including, any third party agencies that deals with the organiser for the purposes of this Contest) be liable for any loss or damage (including loss of income, profits or goodwill or indirect damages, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise in connection with the Contest, although the organiser has been advised of the possibility of such damages in advance, and all such damages are expressly excluded.

4.13 The organiser reserves the absolute right to remove and/or disqualify any Participant and/or entries that it determines to be abusing, tampering or in violation with the entry process or the operation of the Contest or to be acting in breach or violation or potential breach or violation of the Contest’s Terms and Conditions.

4.14 To the extent permitted by law, the organiser, its affiliates and/or authorized third parties shall accept no liability or responsibility for any entries lost, damaged, delayed due to computer, IT or any technical error.

4.15 The organiser’s decision on selection of winners is final, conclusive and binding. No correspondence, inquiries, appeal, objection or dispute pertaining to the decision made by the organiser will be entertained.

5. Intellectual Property

5.1 The Participant agrees to grant the organizer an exclusive right to use the photos submitted through the Contest.

5.2 The Participant hereby consent and authorized the organizer to use the photos in any manner including but not limited to:

a. reproduce the photos in any material form, performs, shows or plays or distributes to the public;

b. import any photos for the purpose of trade or financial gains; and/or

c. exhibits the photos in public.

5.3 The Participant shall be responsible and assume full liability and responsibility for any liability or claims alleging any infringement of trademarks, copyright, patent or any other intellectual property rights of any third party in connection with the Contest.

5.4 In the event that the Participant is aware of any infringement of any trademarks, copyright, patent or any other intellectual property rights of any third party, the Participant shall inform the organizer as soon as possible.

5.5 The Participant shall indemnify and hold the organiser harmless from and against all claims, demands, proceedings, damages, costs, charges, loss and expenses whatsoever for or on account of any infringement of any trademarks, copyright, patent or any other intellectual property rights of any third party in connection with the Contest.

6. Right of organiser

6.1 All entries and photos submission will become the property of the organiser upon submission and the Participants will not claim, use, or exploit the entries for any purpose by any means at any time. By entering the Contest, each Participant agrees and consents that the organiser reserves the right to publish, use the names, personal information and/or photographs of the Participants and/or winners as material for advertising and/or publicity purposes without payment or prior notice, and further agree that by entering the Contest, the Participants and /or the winners waive all rights associated with the image they have submitted for the Contest. Participants shall not be entitled to claim ownership or other forms of compensation on the materials.

6.2 By entering the Contest, each Participant is deemed to have read, understood and agree to be bound by all the Terms and Conditions of the Contest set out herein, including any other requirements set out in any Contest related promotional material, and all amendments, additions, replacements and modifications thereto as may be made from time to time.

6.3 Where necessary, the organiser reserves the right to amend, modify or delete any content and information regarding the Contest including these Terms and Conditions where necessary and any such amendments shall be effective on the date of posting on the Contest website. Please check these terms and conditions regularly to see if there have been any changes.

6.4 The organiser reserves the right to modify, suspend or cancel the Contest at any time without prior notice in the event that it becomes incapable of running as planned, technically interfered or corrupted, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the organiser, despite the best efforts of the organiser.

6.5 Any terms and conditions applicable to the Contest which is illegal, prohibited or unenforceable under any law or regulation shall be ineffective to the extent of such illegality, voidness, prohibition or unenforceability without invalidating the remaining provisions.

6.6 These Terms and Conditions are governed by and construed under the laws of Malaysia.

7. Personal Data

7.1 By entering the Contest, the Participant hereby agree, consent and authorise the organiser, its related and associated companies, and its agencies and companies associated with the Contest to collect, use, disclose, store and process the Participant’s personal data that has been provided for the purpose of the Contest including but not limited to receiving updates, news, promotional and marketing mails or materials from the organiser.

7.2 Examples of Participant’s Personal Data which may be collected, used, disclosed and/or processed for the Contest include the following:

a. name, mobile number, email address, images of receipts and any other personal information relating directly or indirectly to a Participant which have been provided and uploaded to designated microsite by the Participant voluntarily through the submission of forms or in other forms of interactions between the two parties;

b. information pertaining your usage and interaction with the products and services under the Contest and/or the Contest’s website including traffic to and from the Contest’s website and/or

c. photographs or audio-video or other recordings that has been taken in connection with the Contest,

(collectively, “Personal Data”).

7.3 The Participant agree and consent that the organiser may transfer the Personal Data to places outside the Malaysia, to the extent as permitted by laws, for carrying out the purposes of the Contest.

7.4 In particular but without limiting to Clause 1, the organiser is deemed to have obtained the consent of Participant in relation to the Contest to collect, use, disclose, store and/or process Participant personal data for the following purposes strictly in relation to the purposes of the Contest:

a. announcing and publishing Personal Data and/or photos of the Participant for advertising and publicity purposes;

b. responding to Participant’s queries, requests and/or feedbacks;

c. sending Participant’s notifications as well as marketing and promotional messages under and in relation to the Contest (including SMS and e-mail) such as information, updates and/or advertisements and/or other communications in connection with the process of the Contest;

d. carrying out profiling and statistical analysis to improve the Contest; and

e. compliance with any applicable rules, laws and regulations, codes of practice or guidelines or to assist in law enforcement and investigations by relevant authorities.

7.5 In addition to clause 1 and7.2, Participant(s) hereby agree to provide consent for the collection, use, disclosure and/or processing of Personal Data by the organiser and its marketing partners and/or authorized service providers for the following purposes:

a. communicating and providing services including offers, advertisements, promotions or activities conducted at any of the organiser’s property in relation with the Contest.

b. matching Participant’s personal data with other data collected for other purposes and other sources in connection with the provision of the Contest whether by the organiser or third parties that are in direct relation with the organiser.

c. administering and conducting the Contest on behalf of the organiser including announcing the results of the Contest, identifying and contacting winners and publicising and conducting marketing related to the Contest.

d. sending you details of the Contest.

e. conducting consumer and market related research, understanding and determining customer preferences and demographics for the organiser to review, develop and/or improved products, services and marketing communication activities.

f. informing the Participant via email, SMS and other means of communication about or in relation to the Contest.

7.6 Participant(s) hereby agree that the consent granted herein shall not supersede or replace any other consents that have been previously granted to the organiser for the collection, usage, disclosure, storage and/or processing of the Personal Data.

7.7 The organiser will take reasonable precautions to keep Participant’s Personal Data secure and if applicable, requires third party processors to do the same. The organiser shall have the right to disclose the Participant’s Personal Data as may be permitted by the law.

8. Anti-Corruption

8.1 The Participant acknowledges that the organiser is committed to conducting its business in an ethical manner and expects all its employees and parties with which it has a contractual relationship to conduct themselves and/or their business with high ethical standards and to comply with applicable laws for the suppression of corrupt practices (“Anti-Corruption Laws”).

8.2 The Participant, represents and warrants that, to the best of its knowledge, neither it nor any person who (by reference to all relevant circumstances) performs services or acts for or on behalf the Participant  in any capacity (including, without limitation, employees, agents, related corporations, and subcontractors) (“Representatives”) has contravened, or procured or encouraged third parties (including, for the avoidance of doubt, the employees or any person acting on the organiser’s  behalf) to contravene any Anti-Corruption Laws in connection with the Contest. 

8.3 The Participant shall immediately notify the organiser if, any person employed by the organiser or acting on the organiser’s behalf or any of the Participant’s Representatives, has contravened or attempted to contravene any Anti-Corruption Laws in connection with the Contest, and shall take appropriate steps to protect the interests of both the Participant and the organiser. All notices to the organiser in this regard relating to the organiser should be sent to the following email address WhistleblowingCChair@capitaland.com.

8.4 The organiser shall be entitled to reject any entries of a Participant forthwith if the Participant or any of its Representatives has contravened or attempted to contravene any Anti-Corruption Laws, whether in connection with the Contest or otherwise. Such rejection shall be without prejudice to the organiser’s other rights and remedies whether under the Contest or otherwise.
